Biden’s Border Policies Expand in Cruelty

Washington, D.C. – On January 5, 2023, the Biden administration announced plans to effectively expand Title 42; increase the use of expedited removal; revive a version of the Trump administration’s asylum transit ban; and establish a limited parole process for Nicaraguans, Haitians, and Cubans; among other enforcement measures that impact the Southern U.S.-Mexico border.

See a full summary of the enforcement actions here.

The National Korean American Service and Education Consortium (NAKASEC) released the following statement:

Instead of upholding his campaign promise to restore a safe and humane asylum process, President Biden continues to create policies and fund programs that harm people seeking asylum and refuge. For those who cannot be expelled under Title 42, the Department of Homeland Security will increase the use of expedited removal and place a 5-year re-entry ban on migrants whose claim for protection is denied.

It is disingenuous for the Biden administration to frame these actions as an orderly and balanced response to a complex problem; in reality, these policies are a blanket attack on the right to seek asylum. If the Biden administration’s plans come to fruition, even fewer people will have the opportunity to seek safety in the U.S. Narrow requirements and increases in unjust detention and deportation will exacerbate dangers that individuals face.

“While the Biden administration plans to create additional legal pathways for Nicaraguans, Haitians, and Cubans to enter the U.S., these pathways cannot replace access to asylum, nor should they be coupled with plans to expel people who are fleeing imminent threats to their safety,” said Michelle Liang, NAKASEC Policy Manager. “Every person deserves to live safely regardless of their country of origin, financial background, or relationship to U.S.-based sponsors.”

NAKASEC intimately understands the importance of asylum as our founder, Mr. Han Bong Yoon, was a Korean political asylee in the United States.* As a network organizing toward racial, social, and economic justice, NAKASEC urges the Biden administration to create fair, humane, and orderly processes to respond to people’s various reasons for seeking safety in the U.S. that include but are not limited to: political and religious persecution, the effects of climate change, and family reunification. We call on members of Congress to speak out against the Biden administration’s proposed enforcement measures and advocate for a comprehensive and inclusive immigration system that upholds a person’s rights and dignity. The U.S. has long been a beacon of hope for people who seek safety and opportunity. As a global leader, we must honor our promises and legal and moral obligations to people seeking asylum.

(Fact Sheet)
