NAKASEC Condemns the SCOTUS Decision to Overturn Roe v. Wade

NATIONWIDE – The National Korean American Service and Education Consortium (NAKASEC) Network expresses extreme outrage at the 6-3 vote on Friday, June 24, that overturned Roe v. Wade. Since 1973, the decision of Roe v. Wade has prohibited states from implementing bans on abortion in the first two trimesters. Provoked by the recent Dobbs v. Jackson Women’s Health Organization case, the decision will allow states to enact abortion laws at-will and will leave nearly 40 million women in 26 states without any access to safe and legal abortion. Currently 13 states have trigger laws that will automatically ban abortion in the first and second trimester with this ruling, and CNBC estimates that “almost half the states are expected to outlaw or severely restrict abortion as a result of the Supreme Court’s decision.”

To be clear: The NAKASEC Network strongly condemns this decision. We believe that individuals of all genders – women, men, and gender-nonconforming – should have access to reproductive care including but not limited to, access to safe abortion.

Statistically, Black and Asian Americans are the strongest supporters of legal abortion. Seven out of ten Asian Americans support the legalization of abortion and 85 percent of AAPI women believe that women should have the right to abortion access. Black Americans, particularly Black women and gender non-conforming folks, have long been at the forefront of the fight for reproductive rights. Given the historical realities of white supremacy in this country, Black, brown, Asian, poor, disabled, and queer women will be disproportionately harmed by this Supreme Court decision.

Reproductive control as a form of social control spans history from the medical field’s regulation of Black women’s fertility during slavery to the historical sterilization of Indigenous communities, to longstanding inequities in abortion access including cost and lack of access to travel and healthcare for undocumented individuals. Immigrants will now have to weigh decisions that endanger their lives and well-being at every turn. Whether risking travel and encounters with ICE and CBP, or one’s health and well-being, immigrants who already face marginalization will be especially harmed without access to safe abortions. State criminalization of abortion would moreover transform healthcare into yet another prison pipeline for already-marginalized communities.

National Korean American Service and Education Consortium Policy Manager, Michelle Liang, asserts: “NAKASEC serves Korean and Asian American and immigrant communities, and reproductive justice and immigrant justice are inherently linked. Congress must act now and codify abortion access into law. The decision from SCOTUS will harm countless individuals and families, and sets a dangerous precedent for the degree of control the government can assert over an individual’s bodies and lives. We cannot allow this descent into totalitarianism. Now is the time to act and be clear: the right of individuals to have agency over their bodies is non-negotiable.”

Inhe Choi, Executive Director of NAKASEC’s Illinois affiliate HANA Center, remarked, “The SCOTUS decision is a clear statement that they do not value the bodies and lives of women and gender non-confirming folks. This is a gross violation of our human rights. SCOTUS has now invited and allowed the fury driven by patriarchy and misogyny to increase the harm against women and gender non-confirming people, many who are low-income, people of color, immigrants and otherwise vulnerable. 

But we are resilient, creative, and generous. Our struggle for generations has instilled our innate power to resist and build. We will not give up. We will come together as a community and strengthen our fight for our rights and work towards a reimagined world where all people are respected and valued.”

미주한인봉사교육단체협의회(National Korean American Service and Education
Consortium/NAKASEC) 네트워크는 6월 24일(금) 연방대법원의 ‘로 vs. 웨이드(Roe v. Wade)’ 판례를
찬성 6, 반대 3으로 뒤집은 연방대법원의 결정에 큰 분노를 느끼고 있음을 밝힌다. 1973년 이래로
‘로 v. 웨이드’ 판례는 각 주정부에서 여성이 임신 뒤 첫 2~3분기에 낙태를 못하도록 막는 것을
금지해왔다. 최근 ‘도브스 v. 잭슨 여성 건강 기구(Dobbs v. Jackson Women's Health Organization)’
사건에 영향을 받은 이 결정은 주정부에서 마음대로 낙태법을 제정할 수 있게 한다. 이에 따라 26개
주에서 거의 4000만 명의 여성이 안전하고 합법적인 낙태 시술을 받지 못하게 될 것이다.
현재 13개 주에서는 이번 판결로 임신 1~2분기에 낙태를 자동으로 금지시킬 수 있는 법을 이미
제정했다. CNBC는 "대법원의 결정에 따라 거의 절반의 주가 낙태를 불법화하거나 엄격하게 제한할
것으로 예상된다"고 추정했다.
NAKASEC 네트워크는 이 결정을 강력히 규탄하고 있음을 다시 한번 분명히 밝힌다. 우리는 여성,
남성, 성별 비순응자 등 모든 성별의 개인이 안전한 낙태 시술 등 임신 관련 서비스를 받을 수
있어야 한다고 믿는다.
통계적으로 흑인과 아시안 아메리칸은 합법 낙태를 가장 강력하게 지지하고 있다. 아시안 10명 중
7명은 낙태 합법화를 지지하고, 아시아태평양계 여성의 85%는 여성이 낙태 시술을 받을 권리가
있어야 한다고 믿는다. 흑인 중에서도 특히 흑인 여성과 성별 비순응자는 오랫동안 낙태 권리를
위한 투쟁의 최전선에 있다. 이 나라 백인 우월주의의 역사적 현실을 감안할 때 흑인, 라틴계,
아시안, 빈곤층, 장애인, 동성애 여성은 이번 대법원 판결로 더 큰 차별적 피해를 입을 것이다.
사회 통제의 한 형태인 임신과 출산 통제는 노예제도 기간 동안 흑인 여성의 다산에 대한 의료계의
규제에서부터, 원주민 공동체의 역사적 불임화에 이르기까지 존재해왔다. 또 서류미비자들은
장거리 여행과 의료 서비스 제한에 따른 비용 등으로 낙태 서비스를 받지 못하는 오랜 불평등에
처해 있는 등 미국 역사 속에 이어져왔다. 이민자들은 이제 매 순간마다 자신의 삶과 웰빙을
위협하는 결정을 저울질해야 한다. 건강과 웰빙을 위해 장거리 여행에 따른 이민단속국(ICE),
세관국경단속국(CBP)의 검문에 걸릴 위협을 감수해야 하는 등 소외되고 있는 이민자들은 안전한
낙태 시술을 받지 못해 더 큰 피해를 입을 것이다. 또한 낙태를 국가에서 범죄화하면 의료 소외
지역에서 줄지어 교도소에 갇히는 새로운 ‘감옥 파이프라인’이 만들어질 것이다.
NAKASEC 미셸 리앙 정책실장은 다음과 같이 말했다. “의회는 지금 바로 행동에 나서 낙태법을
만들어야 한다. 연방대법원의 결정은 수많은 개인과 가족에게 피해를 줄 것이며 정부의 개인

신체와 삶에 대해 통제 수준에 있어 위험한 선례가 남는다. 우리는 이러한 전체주의로의 퇴보를
허용할 수 없다. 지금은 행동을 하고 분명한 입장을 밝혀야 할 때다. 개인이 자신의 신체에 대해
선택 의지를 가질 수 있는 권리는 협상 대상이 아니다.”
NAKASEC 일리노이주 가입단체인 하나센터의 최인희 사무총장은 이렇게 말했다. “연방대법원의
결정은 여성과 성 불확정자의 몸과 생명을 소중하게 여기지 않는다는 분명한 선언이다. 이것은
우리에 대한 심각한 인권 침해다. 연방대법원은 여성과 성별을 확인하지 않는 사람들, 다수
저소득층, 유색인종, 이민자 및 기타 취약한 계층에 대한 피해가 늘어나도록 초대하고 허용하는
꼴이다.”
하지만 우리는 회복을 할 수 있고 창의적이며 관대하다. 세대에 걸친 우리의 투쟁은 저항하고
건설하는 우리의 타고난 힘을 만들어냈다. 우리는 포기하지 않을 것이다. 우리는 하나의 공동체로
뭉쳐서 우리의 권리를 위한 투쟁을 강화하고 모든 사람이 존중되고 가치 있게 재창조되는 세상을
위해 일할 것이다.”
지금 행동에 나서야 한다. 우리는 지지자들이 풀뿌리 낙태 기금, 특히 적대 국가의 낙태 기금에
기부할 것을 권장한다. 낙태를 받아야 하는 사람들을 위한 편안하고 안전한 스스로의 낙태 방법도
