10 Years Later: A Permanent Pathway Needed Now More Than Ever

Nationwide – Today marks 10 years since the creation of Deferred Action For Childhood Arrivals (DACA) Program. Enacted via executive order by former President Barack Obama in 2012, the temporary program grants work permits and safety from deportation for young people who arrived in the United States before June 15, 2007. DACA was hard-fought and hard-won by many Black, brown, and Asian immigrants who organized and fought relentlessly for years. While the program provides relief for hundreds of thousands, millions were excluded from the possibility of even temporary relief. The continued irresponsibility of Congress to enact permanent legislation in the form of a pathway to citizenship means that the program, as well as millions of lives, hang in perpetual balance. The DACA program itself is also temporary – in July 2021, Judge Andrew Hanen of Texas deemed DACA unlawful and ordered that new applications be halted. The Fifth Circuit Court of Appeals is scheduled to begin hearing oral arguments on DACA in early July. The future of the program is unknown, underscoring the urgency for a permanent solution.

The National Korean American Service and Education Consortium (NAKASEC) is a national network of five affiliates serving and organizing Korean and Asian communities. Our community members experience firsthand the struggles of being undocumented in the United States. It is clear that citizenship is a basic need – vital for people to build stability and access work, education, healthcare, housing, and protection from inhumane detention, deportation, and family separation. Without it, many live in fear and danger.

A community member with DACA at Woori Center, NAKASEC’s Pennsylvania affiliate, remarks on temporary relief: “For me, DACA means hope, like having an umbrella during a hard rain – it helps but does not do much. It may protect me for a while, but there is a constant threat of being drenched under the rain. Even with DACA, I am under the endless uncertainty due to its unstable program status. I hope we can work together to have a long-lasting protection like having a roof over our head instead of [just] an umbrella on a rainy day.”

An undocumented community member without DACA at MinKwon Center, NAKASEC’s New York affiliate shares: “​​I arrived in the United States in 2011, when I was only 9 years old. In order to be applicable for DACA, you must have been continuously residing in the U.S. since June 2007, which prevented me from obtaining the qualification. There is no sense of belonging as a person without any protection. My status is blocking me from having a bright future. I cannot legally work in the U.S., I cannot study abroad, and I cannot reunite with my family. All 11 million undocumented immigrants deserve a pathway to citizenship.”

Jung Woo Kim, DACA recipient and co-director at NAKASEC, reflects: “I was one of the privileged ones who got DACA when it became available in 2012. I went from no driver’s license nor valid government-issued ID, no health insurance, and no protection from deportation; to being able to have a driver’s license, health insurance, and protection from deportation. Every two years I must reapply, and the fear and uncertainty is not lost on me. Living and paying taxes to this country for 22 years and getting only 2 years of temporary status at a time is morally wrong. How much longer will we have to wait for our humanity to be recognized by the United States? What will it take for Congress to realize that we are all people, and we all deserve to live safely. The greed of a few should not harm the lives of many. Citizenship for ALL must be granted now!

Congress can and must create permanent solutions in the form of a pathway to citizenship for the 11 million people who live, work, and love in the United States. The refusal of Congress to act and the fear-mongering of some is not new or isolated. It has festered from the Anti-Blackness and xenophobia embedded in the United States’ foundation, that has for centuries propelled exclusion, violence, and harm upon countless Black, brown, and Asian people. Imagine if instead of repeating violent histories, the United States created a new legacy: One that recognizes the dignity and humanity of all people, Black and white, Asian and Latine, Indigenous and immigrant!

오늘은 서류미비 청년 추방유예(DACA) 프로그램이 시작된 지 10년이 되는 날이다. 버락 오바마 대통령의 행정명령으로 2012년 만들어진 DACA는 2007년 6월 15일 이전에 미국에 온 청년들이 추방을 당하지 않고 취업을 할 수 있도록 허용한 임시 프로그램이다. 

DACA는 흑인과 라틴계, 아시안 이민자들이 수년간 거세게 싸운 결과 얻어낸 프로그램이다. 이 프로그램이 수십만 명을 구제해 주고 있는 동안 수백만 명은 일시적인 구제책이 제공될 가능성에서 조차 제외되고 있다. 무책임한 의회가 시민권 취득을 보장하는 영구적인 법 제정을 계속해서 미루고 있는 동안 수백만 명의 생명들이 끊임없는 외줄타기로 몰리고 있다. DACA 자체도 임시 프로그램일 뿐이다. 2021년 7월 텍사스의 앤드류 하넨 판사는 DACA가 위법이라고 신규 신청서 처리를 중단시켰다. 오는 7월부터 제5연방항소법원에서 DACA에 대한 심리가 다시 시작된다. 영구적인 해결책이 긴급히 필요한 상황 속에서도 프로그램의 앞날은 불확실하다.  

미주한인봉사교육단체협의회(NAKASEC)는 5개 가입단체가 활동하는 전국 네트워크로 한인과 아시안 커뮤니티를 위해 봉사하고 활동한다. 미국에서 서류미비자로 살아가는 우리 커뮤니티 주민들은 고통을 온몸으로 경험하고 있다. 일을 하고, 교육과 보건, 주택 그리고 비인간적인 감금과 추방, 가족 생이별 등으로 보호받으며 안정적인 삶을 이어가려면 시민권은 기본적으로 꼭 필요하다. 이것 없이는 수많은 사람들이 공포와 위험 속에 살아간다. 

NAKASEC의 펜실베이니아주 가입단체인 우리센터의 DACA 신분인 한 커뮤니티 주민은 임시 구제책에 대해 이렇게 말했다. “나에게 DACA는 거센 빗속의 우산과 같은 희망을 뜻했지만 많은 것을 해주지는 못했다. 얼마간은 나를 보호했지만 거센 빗속으로 내몰릴 위협이 끊이지 않았다. DACA 신분이라도 불안정한 프로그램 상황 때문에 끝없는 불안을 겪고 있다. 우리 모두가 함께 노력해 우리 머리 위로 비 오는 날의 우산 대신 지붕이 놓이는 장기적인 보호가 이뤄지길 바란다.” 

NAKASEC 뉴욕 가입단체인 민권센터의 DACA 신분도 얻지 못한 서류미비 커뮤니티 주민은 이렇게 말했다 “나는 2011년 미국에 입국했다. 나는 9살이었다. DACA 신청을 하려면 2007년부터 계속 미국에 살았어야 한다. 그래서 나는 자격 조건이 되지 않는다. 아무런 보호를 받지 못하는 상황에 처하면 사람은 결속감을 느낄 수 없다. 나의 신분은 밝은 앞날을 가로막고 있다. 나는 미국에서 합법적으로 일할 수 없고, 해외로 나가 공부를 할 수도 없고, 내 가족과 만날 수도 없다. 1100만 서류미비 이민자들은 시민권 취득 기회를 얻어야 할 자격이 있다.” 

DACA 신분인 NAKASEC 김정우 공동 사무총장은 이렇게 말한다. “나는 2012년 시작된 DACA의 혜택을 받은 운 좋은 사람이다. 운전면허도, 쓸 수 있는 정부 신분증도, 건강보험도, 추방으로부터의 보호도 받지 못하던 내가 운전면허, 건강보험, 추방 유예 혜택을 받았다. 하지만 나는 2년 마다 갱신 신청을 해야 하며 공포와 불확실성은 나를 떠나지 않았다. 이 나라에 살며 세금을 낸지 22년이 지난 내가 단지 2년 간의 임시 신분만 얻는 다는 것은 부당하다. 얼마나 더 오래 기다려야 우리의 존엄을 미국이 이해할 수 있을까? 의회가 우리도 사람이고, 안전하게 살아갈 권리가 있다는 것을 어떻게 해야 알 수 있을까? 몇몇의 탐욕이 수많은 사람들의 삶을 해쳐서는 안된다. 시민권 취득의 길은 바로 지금 열려야 한다!” 

의회는 이 땅에 살고, 일하고, 미국을 사랑하는 1100만 주민에게 시민권 취득을 허용하는 영구적인 해결책을 만들 수 있고 만들어야 한다. 이에 대한 의회의 거부와 몇몇의 공포를 조장하는 행동은 새롭거나 일회적인 일이 아니다. 건립 때부터 시작된 반흑인, 외국인 혐오증이 미국을 훼손하고 있다. 수 세기 동안 흑인과 라틴계, 아시안에 대한 박탈과 폭력이 셀 수 없이 이어지고 있다. 폭력적인 역사를 반복하는 대신 새로운 전통을 상상해보라. 흑인과 백인, 라틴계, 원주민 그리고 이민자 등 모든 사람의 존엄을 인정하는 그런 전통을 만들어야 한다.
