Virginia Attorney General Mark Herring Announces In-State Tuition for DACA students

Virginia Students Welcome In-State Tuition for DACA Recipients

Alexandria, VA – On April 29, 2014, Virginia Attorney General Mark Herring announced in-state tuition will be available for individuals who received DACA (Deferred Action for Childhood Arrivals) status. This announcement was made at Northern Virginia Community College in front of DACA recipients, Virginia Assembly delegates & senators, Virginia public university presidents, and community members.

According to the Attorney General’s Office, “Conferral of DACA by the Department of Homeland Security has the effect of making the DACA recipient lawfully present in the United States. …Once a student has had DACA for one year, he or she is eligible to establish domicile and qualify for in-state tuition.”

Virginia Attorney General Mark Herring announced, “My team and I have analyzed and reviewed the relevant state and federal law, and I have concluded that under current Virginia Law in-state tuition rates can and should be extended to Virginia students lawfully residing here under the DACA program,” in front of Virginia Dreamer students.

“NAKASEC worked hard in 2013 advocating for in-state tuition for undocumented and DACA students. We will continue advocating for all Virginia immigrant students to have access to higher education like their peers. We will not stop at the state level, but continue working at the federal level for immigration reform for all of our immigrant communities,” said Dae Joong (DJ) Yoon, Executive Director of NAKASEC.
