The Biden Administration and Congress Must Do More to Protect DACA and Immigrants

Washington, D.C. – On Wednesday, August 24, President Biden’s Department of Homeland Security issued their final rule for the Deferred Action for Childhood Arrivals (DACA) program. The rule, while maintaining work permits and protection from deportation, does not expand eligibility to include growing numbers of high school graduates. Due to ongoing court cases, the application process for first-time applicants remains on hold.

The National Korean American Service and Education Consortium (NAKASEC) issued the following statement in response:

The Biden administration can and must do more to protect DACA and immigrants across the United States. More than 800,000 individuals have participated in the program since its inception ten years ago, and tens of thousands of immigrant youth still await adjudication on their first-time applications. DACA – hard-fought and hard-won by the relentless work of Black, brown, Asian, and immigrant individuals and communities – helped incorporate hundreds of thousands of people into the workforce and higher education spaces while protecting them from detention and deportation. Already the DACA program is temporary and restrictive, and continued attacks on the program – along with increases in mainstream xenophobic and racist rhetoric – underscore the deep need for President Biden and Congress to create permanent protections for immigrant communities.

Currently, there is a bill introduced in the House that would update an existing law known as “registry,” and would create a more comprehensive and humane immigration system. There are 11 million undocumented immigrants in the United States, and every person – Black and white, Asian and brown, immigrant and citizen alike, deserve to live safely and fully with their loved ones.

DACA recipient and NAKASEC Co-Director, Jung Woo Kim, said: “I am frustrated that the Biden administration has approved a rule that does not expand or strengthen the DACA program. DACA is vital for many – including myself, but there are millions more who remain without recourse. Given that the rule cannot shield the program from ongoing attacks, it is urgently imperative that President Biden and Congress legislate permanent protections for immigrants in the form of a pathway to citizenship for all 11 million. In doing so, President Biden and Congress can make clear that the United States – established by diverse groups of immigrants – is committed to its belief in justice for all.”

The Deferred Action for Childhood Arrivals (DACA) program was created in 2012 through an executive order of then-President Barack Obama. A temporary program requiring renewal every two years, DACA grants work permits and safety from deportation for hundreds of thousands of young people who arrived in the United States before June 15, 2007. In July 2021, Judge Andrew Hanen of Texas deemed DACA unlawful and ordered that new applications be halted. On July 6, 2022, the Fifth Circuit Court of Appeals in New Orleans, Louisiana, heard oral arguments on the case. The DACA program remains intact and current DACA recipients should renew their applications as soon as possible. It is important to note that this rule does not change DACA for current recipients, while the hold on processing new applications remains.

바이든 행정부와 의회는 DACA와 이민자를 보호하기 위해 더 많은 일을 해야 합니다. 

8월 24일 바이든 대통령의 국토안보부는 서류미비 청년 추방유예(DACA) 프로그램에 대한 최종 규정을 발표했습니다. 새 규정은 취업 승인과 추방 유예를 유지하고 있습니다. 하지만 늘어나고 있는 고교 졸업생들을 포함시키는 DACA 수혜 확대 조치는 없었습니다. 현재 진행 중인 법원 소송에 따라 여전히 신규 신청자의 서류 처리는 보류되고 있습니다. 

이에 미주한인봉사교육단체협의회(NAKASEC)는 다음과 같은 입장을 밝힙니다. 

바이든 행정부는 미 전역의 DACA 청년들과 이민자들을 보호하기 위해 더 많은 일을 할 수 있고 또 해야 합니다. 10년 전 프로그램이 시작된 이래 80만 명이 DACA 신분을 얻었고, 수만여 명의 이민자 청년들이 신규 신청에 대한 판결을 기다리고 있습니다. 흑인, 라틴계, 아시안 그리고 이민자 커뮤니티의 끈질긴 노력으로 힘들게 싸워 얻어낸 DACA는 구금과 추방으로부터 수십만 명을 보호하고, 이들이 일자리를 찾고 고등교육을 받을 수 있도록  도왔습니다. 하지만 DACA는 일시적이고 제한적인 프로그램입니다. 주류사회에서 외국인 혐오와 인종차별 논리가 확대되고 있는 가운데 DACA에 대한 공격도 극심해지고 있습니다. 바이든 행정부와 의회가 이민자 커뮤니티를 보호하는 영구적인 방안을 마련해야 합니다. 

현재 ‘영주권 등록 제도’를 개편해 보다 포괄적이고 인도적인 이민제도를 만드는 법안이 연방하원에 상정돼 있습니다. 미국에는 1100만 서류미비 이민자가 있으며 흑인과 백인, 아시안과 라틴계, 이민자와 미국 시민 등 모든 사람들은 사랑하는 사람들과 완전히, 안전하게 살아갈 자격이 있습니다. 

DACA 수혜자, NAKASEC 김정우 공동 사무국장 : “바이든 행정부가 DACA 프로그램을 확대하거나 강화하지 않는 규정을 승인한 것에 실망을 느낍니다. DACA는 나를 포함한 많은 사람들에게 꼭 필요하지만, 이에 혜택을 받지 못하고 있는 수백만 명이 더 있습니다. 새 규정이 계속되는 DACA에 대한 공격을 막을 수 없기에 바이든 대통령과 의회는 1100만 모두에게 시민권 취득을 길을 열어주는 영구적인 보호책을 입법화하는 것이 시급합니다. 이를 통해 바이든 대통령과 의회는 다양한 이민자 집단들에 의해 세워진 미국이 ‘모두를 위한 정의’라는 신념을 지킬 의지가 있다는 것을 분명히 할 수 있습니다.”    

서류미비 청년 추방유예(DACA) 프로그램은 버락 오바마 전 대통령의 행정명령으로 2012년에 만들어졌습니다. 2년 마다 갱신을 해야 하는 임시 프로그램인 DACA는 2007년 6월 15일 이전에 미국에 입국한 수십만 젊은이들에게 노동 허가를 제공하고 추방을 당하지 않도록 보호합니다.하지만 2021년 7월 텍사스주 앤드류 하넨 판사는 DACA를 불법으로 간주하고 신규 신청서 처리를 중단시켰습니다. 2022년 7월 6일 루이지애나주 뉴올리언스의 연방 제5 순회 항소법원은 이 사건에 대한 구두 변론 심리를 진행했습니다. DACA 프로그램은 아직 유지되고 있으며 현 DACA 수혜자는 가능한 빨리 갱신 신청을 해야 합니다. 새 규정은 현재 DACA 신분인 사람에 대해서는 바뀌는 내용이 없지만 신규 신청서 처리는 여전히 보류 중입니다.
